Abyss – Terms of Service

About these terms

These terms are an agreement between you and Infinite Forge Games ("we", "us") about the Abyss app for Android (package com.infiniteforgegames.abyss). They cover playing the game and buying items in it. By installing or playing Abyss you agree to them. If you don't agree, please don't use the game.

Infinite Forge Games is a trader. Our trader details (name, address and contact details) are shown on the Abyss listing on Google Play. You can always reach us at support@infiniteforgegames.com.

Nothing in these terms takes away rights you have by law as a consumer where you live. If a part of these terms conflicts with those rights, your rights win.

Google Play

You download Abyss and pay for in-app items through Google Play, so the Google Play Terms of Service also apply. Google handles payment and billing; we never see your payment details. How we and Google handle data is explained in our Privacy Policy.

Who can play

Abyss is made for players aged 13 and over. If you are under the age of majority where you live, you need a parent's or guardian's permission to buy in-app items, and they accept these terms for you.

Your licence to play

We give you a personal, non-exclusive, non-transferable licence to install and play Abyss on devices you own or control, for your own non-commercial use. The game, its story, art, music, code and names belong to Infinite Forge Games. Please don't copy, resell, modify, reverse-engineer or redistribute the game, or use cheats, bots or modified versions of it, except where the law lets you do so regardless of these terms.

In-app items

Abyss is free to play, and the whole story can be finished without spending anything. You can choose to buy optional items: one-time items (such as the Supporter Pack, the Explorer's Kit, the Aquarium Wing and hull paints) and consumable items (such as the Pouch of Marks, which adds in-game marks).

What you buy. Each item is a licence to use digital content inside Abyss. It is not property, has no cash value, cannot be exchanged for money or other items, and cannot be transferred, sold or gifted to another account or person.
Prices. Google Play shows you the final price, in your currency and including any taxes it collects, before you confirm a purchase.
Delivery. Items are delivered in the game as soon as Google Play confirms your payment.
Restoring one-time items. One-time items are tied to the Google account you bought them with. If you reinstall the game or change phones, sign in to the same Google account and use Settings → RESTORE PURCHASES.
Consumables and progress live on your phone. Marks (including those from a Pouch of Marks) and your game progress are saved only on your device. They are lost if you uninstall the game or clear its data, and we cannot recover them, because we keep no copy.

Refunds and your right of withdrawal

You can ask for a refund through Google Play under Google Play's refund policies. You can also email us: tell us your order number (it starts with GPA. and is in your Google Play receipt) and we will look at your request fairly. Where we agree to a refund, it is paid through Google Play. If a one-time item is refunded or the payment is reversed, the item is removed from the game.

If you live in the European Union, the United Kingdom or another country that gives consumers a right to cancel online purchases (often within 14 days), that right ends once digital content has been delivered, if you agreed to immediate delivery and acknowledged that you would lose the right when you bought it. Because in-app items are delivered immediately, you will normally not be able to cancel a purchase once the item is in your game. This does not affect your right to a remedy if an item is faulty or not as described.

If an item you bought doesn't arrive or doesn't work, contact us and we will put it right, or refund it if we can't.

Abyss has no forced ads. You can choose to watch a short ad for an in-game reward. Rewards are given only when an ad is completed, ads are not always available, and there is a daily limit on ad rewards. Ads are provided by Google AdMob; see our Privacy Policy for what that means for your data.

Playing fair

Please don't cheat, exploit bugs to gain items, tamper with purchases or the game's files, or interfere with the game's ads or billing. If you find a bug, we'd be grateful if you told us about it.

Changes to the game

We keep improving Abyss, so content, balance, features and prices may change in updates. We won't take away a one-time item you paid for without good reason; if we ever have to change or remove one in a way that matters to you, we will give you something of similar value or a refund where the law requires it. We may stop offering an item for sale, or one day stop supporting or distributing the game. If that happens, we will try to give reasonable notice in the game or on this website.

Our responsibility to you

We make Abyss with care, but we can't promise it will always be available, or free of bugs or interruptions, and we provide it "as is" to the extent the law allows.

To the extent the law allows, we are not liable for indirect or unforeseeable losses, or for loss of game progress, and our total liability to you for anything connected with Abyss is limited to the amount you paid us for in-app items in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud or for death or personal injury caused by negligence, or your statutory rights as a consumer.

Ending this agreement

You can stop playing at any time by uninstalling the game. If you seriously or repeatedly break these terms (for example by fraudulently reversing payments), we may stop providing purchases or support to you. The sections on ownership, our responsibility and disputes continue to apply after the agreement ends.

Disputes and governing law

If something goes wrong, please email us first; most problems can be solved quickly that way. If we can't settle a dispute within 30 days, either of us may take it to the courts.

These terms are governed by the laws of the State of Florida and applicable United States federal law, without regard to conflict-of-law rules. If you live in another country, you also keep the protection of the mandatory consumer laws of your country, and you may bring a claim in the courts where you live.

Changes to these terms

We may update these terms, for example when we add features or when the law changes. We will change the date above, and for significant changes we will tell you in the game or on this website before they take effect. Changes don't apply to purchases you made before the change took effect.
